1. DEFINITION AND SUBJECT OF THE AGREEMENT
1.1 The sales transaction executed on this website constitutes a distance contract ("Agreement") pursuant to Article 50 et seq. of Italian Legislative Decree (D.Lgs.) dated 6 September 2005, no. 206 (the "Consumer Code").
This Agreement governs the sale of movable property between EP DISTRIBUTION SRL, with registered headquarters in Corato (BA), Via Amerigo Vespucci, 54A, VAT number 08160920727 ("EP DISTRIBUTION") and the purchaser (the "Customer").
The Agreement is formally executed directly upon EP DISTRIBUTION's acceptance of a purchase proposal submitted by the Customer via telephone, or via internet through this website (the "Site") and/or any other EP DISTRIBUTION remote sales channel, in accordance with the procedures outlined in subsequent Article 3.
1.2 These general sales conditions (the "General Conditions"), and specifically all information required under Article 52 of the Consumer Code as provided to the Customer by EP DISTRIBUTION over the phone and published on the Site, shall remain valid and in effect until modified and/or supplemented by EP DISTRIBUTION. Any modifications or supplements to the General Conditions shall take effect on the date they are publicly announced, and will apply only to sales executed on or after that date. The most recent updated version of the General Conditions is the one available on the Site.
2. PRICING
All product sales prices listed on the Site and/or any other EP DISTRIBUTION remote sales channel include VAT and all other applicable taxes. Delivery costs are published on the Site and/or any other EP DISTRIBUTION remote sales channel; for telephone orders, these costs will be restated to the Customer by an EP DISTRIBUTION representative.
3. PURCHASE AND PAYMENT METHODS
3.1 A telephone-executed Agreement is formally finalized when EP DISTRIBUTION notifies the Customer (who contacted EP DISTRIBUTION by phone, submitted a purchase proposal, and provided the representative with all necessary data to register their name, process their purchase order, and confirm their chosen payment method) that their purchase proposal has been accepted.
3.2 For purchase proposals submitted via the Site, the Customer will receive a summary email from EP DISTRIBUTION confirming that their purchase proposal is under review. The proposal will be deemed accepted unless EP DISTRIBUTION sends a contradictory email or phone notice to the Customer within 7 (seven) calendar days of receipt of the summary email. Upon expiration of this period, the internet-executed Agreement is considered fully finalized.
3.3 The Customer may select one of the following payment methods: (a) credit card, processed at the time the order is submitted; or (b) any other payment method periodically listed as valid by EP DISTRIBUTION on the Site.
4. PRODUCT DELIVERY - COMPLAINTS
4.1 EP DISTRIBUTION will deliver products to the address specified by the Customer within 10 (ten) days of the Agreement being finalized.
4.2 All complaints may be submitted to the following address: EP DISTRIBUTION Srl. – 70033 Corato (BA), Via Amerigo Vespucci 54A, VAT number 08160920727.
5. PRODUCT AVAILABILITY
EP DISTRIBUTION Srl only accepts Customer orders within the limits of available product stock held by EP DISTRIBUTION. Accordingly, EP DISTRIBUTION's acceptance of the Customer's submitted purchase proposal is conditional on the availability of the requested products. EP DISTRIBUTION undertakes to promptly notify the Customer of any unforeseen product shortages caused by excess demand or other causes.
6. WARRANTIES AND SUPPORT
All products purchased by the Customer are covered by all applicable EP DISTRIBUTION warranty and support regulations for consumer goods sales.
7. CUSTOMER OBLIGATIONS
The Customer declares and warrants that: (I) they qualify as a consumer as defined in Article 3 of the Consumer Code; (II) they are of legal age; (III) all data they provide to execute the Agreement is accurate and truthful.
8. RIGHT OF WITHDRAWAL
8.1 The Customer has the right to withdraw from the executed Agreement without any penalty and without specifying a reason, within 14 days of receiving their products. The withdrawal period expires 14 days after the date the Customer takes physical possession of the final item in their order. The Customer may exercise this right of withdrawal within the aforementioned period by submitting a written notice to EP DISTRIBUTION Srl. – 70033 Corato (BA), Via Amerigo Vespucci 54A, VAT number 08160920727, sent via email or fax.

10. COMPETENT COURT
This Agreement is governed by Italian law. All disputes related to the application, execution, interpretation, or breach of the Agreement will fall under the exclusive jurisdiction of the Court of Trani.
