1. DEFINITION AND PURPOSE OF THE CONTRACT
1.1 The sales agreement executed on this website is a distance contract ("Contract") pursuant to Art. 50 et seq. of Legislative Decree no. 206 of 6 September 2005 ("Consumer Code").
The purpose of the Contract is the sale of movable property between EP DISTRIBUTION SRL, with registered office in Corato (BA), Via Amerigo Vespucci, 54A, VAT number 08160920727 ("EP DISTRIBUTION") and the purchaser ("Customer").
The Contract is finalized directly through EP DISTRIBUTION’s acceptance of a purchase proposal submitted by the Customer via telephone, via the internet on this website ("Site"), and/or via any other of EP DISTRIBUTION’s distance sales systems, in accordance with the procedures outlined in Article 3 below.
1.2 These general sales conditions ("General Conditions") and, in particular, the information set out in Art. 52 of the Consumer Code, as provided to the Customer by EP DISTRIBUTION over the telephone and published on the Site, shall remain valid and effective until modified and/or supplemented by EP DISTRIBUTION. Any modifications and/or additions to the General Conditions shall take effect from the date they are communicated to the public, and shall apply to sales completed on or after that date. The most recently updated version of the General Conditions is the one accessible on the Site.
2. PRICES
The sales prices of the products listed on the Site and/or via any other of EP DISTRIBUTION’s distance sales systems include VAT and all other applicable taxes. Delivery charges are specified on the Site and/or via any other of EP DISTRIBUTION’s distance sales systems; for telephone orders, these charges are repeated to the Customer by the EP DISTRIBUTION operator.
3. PURCHASE AND PAYMENT METHODS
3.1 A telephone-based Contract is finalized when the Customer (who contacted EP DISTRIBUTION by telephone to submit a purchase proposal, also providing the operator with all data required to register their name, process their purchase order, and record their chosen payment method) is notified that their proposal has been accepted.
3.2 For purchase proposals submitted via the Site, the Customer will receive a summary email from EP DISTRIBUTION notifying them that their purchase proposal is under review. The proposal is deemed accepted unless EP DISTRIBUTION sends a contrary email or telephone notification within 7 (seven) calendar days of receiving the summary email. Once this period elapses, the internet-based Contract is considered fully finalized.
3.3 The Customer may choose one of the following payment methods: (a) credit card, to be processed at the time the order is submitted; or (b) any other payment method that EP DISTRIBUTION may from time to time list as valid on the Site.
4. PRODUCT DELIVERY - CLAIMS
4.1 EP DISTRIBUTION delivers products to the address specified by the Customer within 10 (ten) days of the Contract being finalized.
4.2 Any claims may be sent to the following address: EP DISTRIBUTION Srl. – 70033 Corato (BA), Via Amerigo Vespucci 54A, VAT number 08160920727.
5. PRODUCT AVAILABILITY
EP DISTRIBUTION Srl accepts Customer orders limited to the quantities of requested products that are in EP DISTRIBUTION’s stock. Accordingly, EP DISTRIBUTION’s acceptance of the Customer’s submitted purchase proposal is conditional on the availability of the products in question. EP DISTRIBUTION undertakes to promptly notify the Customer of any unforeseen product unavailability caused by excess demand or other causes.
6. WARRANTIES AND SUPPORT
The provisions governing warranties and support for consumer goods sales apply to EP DISTRIBUTION for all products purchased by the Customer.
7. CUSTOMER OBLIGATIONS
The Customer declares and warrants that: (I) they qualify as a consumer pursuant to Art. 3 of the Consumer Code; (II) they are of legal age; (III) all data they provided to execute the Contract is accurate and truthful.
8. RIGHT OF WITHDRAWAL
8.1 The Customer has the right to withdraw from the executed contract, without any penalty and without specifying a reason, within 14 days of receiving the products. The withdrawal period expires 14 days from the date the Customer takes physical possession of the final product. The Customer may exercise the right of withdrawal within the aforementioned period by sending written notice to EP DISTRIBUTION Srl. – 70033 Corato (BA), Via Amerigo Vespucci 54A, VAT number 08160920727, via email and fax.
9. PROCESSING AND CONFIDENTIALITY OF PERSONAL DATA INFORMATION pursuant to Art. 13 of Regulation (EU) 2016/679, known as the GDPR

10. COMPETENT COURT
The Contract is governed by Italian law. Any dispute relating to the application, execution, interpretation, or breach of the Contract shall fall under the jurisdiction of the Court of Trani.
