General Conditions of Sale

1. Definition and subject of the Contract

1.1 The sale and purchase made on this site is a distance contract ("Contract") pursuant to Articles 45 et seq. of Legislative Decree of 6 September 2005, no. 206 (the "Consumer Code").

The Contract concerns the sale of movable goods between ALTERYA LABS s.r.o., with registered office at Revoluční 1082/8, 110 00 Prague, Czech Republic, VAT number CZ22595694 ("ALTERYA LABS") and the buyer ("Customer").

The Contract is concluded directly when ALTERYA LABS accepts a purchase proposal submitted by the Customer via telephone or internet on this site ("Site") and/or through other distance sales systems of ALTERYA LABS, based on the terms described in the following Article 3.

1.2 These general conditions of sale ("General Conditions") and, in particular, the pre-contractual information referred to in Article 49 of the Consumer Code, as provided by ALTERYA LABS to the Customer and published on the Site, shall remain valid and effective until they are amended and/or supplemented by ALTERYA LABS. Any amendments and/or supplements to the General Conditions shall take effect from the date they are notified to the public and shall apply to sales made from that date. The most recent updated version of the General Conditions is the one available on the Site.

2. Prices

The selling prices of the products shown on the Site and/or through any other distance sales systems of ALTERYA LABS include VAT and all other taxes. Delivery costs are indicated on the Site and/or through any other distance sales systems of ALTERYA LABS and, in the case of a telephone order, are repeated to the Customer by ALTERYA LABS's operator.

3. Purchase and payment methods

3.1 The telephone Contract is finalized by communicating to the Customer (who has contacted ALTERYA LABS by telephone and submitted, on that occasion, a purchase proposal, also providing the operator with the necessary details for the registration process of their name, the purchase order and the chosen payment method) that the proposal has been accepted.

3.2 In the case of purchase proposals submitted via the Site, the Customer will receive a summary email from ALTERYA LABS, notifying them that their purchase proposal is being processed and shall be deemed accepted, unless a contrary communication via email or telephone is sent by ALTERYA LABS within 7 (seven) calendar days from receipt of the summary email. After that period, the internet Contract shall be deemed finalized.

3.3 The Customer will be allowed to choose one of the following payment methods: (a) by credit card, to be made at the time of submitting the order; or (b) via any other payment method that is indicated as valid by ALTERYA LABS on the Site from time to time.

4. Delivery of products – Complaints

4.1 ALTERYA LABS delivers the products to the address indicated by the Customer within 10 (ten) days from the conclusion of the Contract.

4.2 Any complaint may be submitted to the following address: ALTERYA LABS s.r.o. – Revoluční 1082/8, 110 00 Prague, Czech Republic, VAT number CZ22595694, or via email to the address indicated on the Site.

5. Availability of products

ALTERYA LABS accepts Customer orders within the limits of the quantities of products it has available. Therefore, acceptance by ALTERYA LABS of the purchase proposal submitted by the Customer is subject to the availability of the products themselves. ALTERYA LABS undertakes to promptly notify the Customer of any unforeseen product unavailability due to excess demand or other causes.

6. Warranties and assistance

For products purchased by the Customer, the rules regarding legal conformity warranty and assistance relating to the sale of consumer goods (Articles 128 et seq. of the Consumer Code) apply.

7. Customer's obligations

The Customer declares and guarantees: (i) that they are a consumer as defined in Article 3 of the Consumer Code; (ii) that they are of legal age; (iii) that the details they provided for the execution of the Contract are correct and truthful.

8. Right of withdrawal

8.1 The Customer has the right to withdraw from the entered Contract, without any penalty and without stating a reason, within 14 (fourteen) days from receipt of the products. The withdrawal period expires after 14 days from the day the Customer takes physical possession of the last good. The Customer may exercise the right of withdrawal, within the aforementioned period, by sending a written communication to ALTERYA LABS s.r.o. – Revoluční 1082/8, 110 00 Prague, Czech Republic, to be sent via email or regular mail.

9. Processing and confidentiality of personal data

10. Competent court

The Contract is governed by Italian law. Any dispute relating to the application, execution, interpretation and breach of the Contract shall be within the jurisdiction of the Court of Trani.
