FAQ CBD Legality
Is CBD legal in Italy?
CBD (cannabidiol) is a non-narcotic molecule extracted from hemp and is not listed in the tables of narcotic substances. In Italy, the marketing of hemp-based products is permitted when the THC content (the psychoactive principle) remains within the limits established by law and when the products comply with the permitted purposes and descriptions. Sensimilla products are selected to comply with current legal limits.
What is the allowed THC limit for hemp in Italy?
The cultivation of industrial hemp is governed by Law no. 242 of 2016, which refers to varieties listed in the Common European Catalogue. For these varieties, the THC content during cultivation is permitted up to 0.2%, with a tolerance threshold of up to 0.6% which exempts the farmer from liability. At the European level, the reference value for industrial hemp has been updated to 0.3%. Finished products intended for sale must, however, maintain a THC content within legal limits.
Note: Percentage values and related regulatory references should be confirmed with a legal consultant, as the matter is subject to interpretation and updates.
What's the difference between light cannabis and marijuana?
- Cannabis light (legal hemp): derives from hemp varieties with a low THC content, within legal limits, and has no intoxicating effects. This is the type of product that Sensimilla deals with.
- Marijuana: refers to inflorescences with a THC content exceeding the permitted thresholds, such as to produce psychoactive effects. Its possession and sale are regulated by drug laws.
The substantial difference is therefore the THC content: cannabis light complies with legal limits, while marijuana does not.
What does Law 242/2016 on hemp stipulate?
Law 242/2016 promotes the cultivation and supply chain of industrial hemp (Cannabis sativa L.) from certified seeds listed in the European Catalogue. It regulates the permitted uses of the plant—including food, cosmetics, materials, semi-finished products, and floricultural uses—and establishes the conditions for lawful cultivation. It does not, by itself, authorize every use of the finished product: the admitted end uses depend on the type of product and the labels affixed.
Are hemp flowers legal?
The marketing of low-THC hemp inflorescences is subject to a complex regulatory framework and jurisprudential guidelines that have evolved over time. For this reason, inflorescences are generally offered with specific usage labels and not as consumer products. We invite you to always read the label and the information on the product sheet.
What are inflorescence-based products used for?
Inflorescences and some derivatives are marketed as collectible items / for technical use and, where indicated, are not intended for food use or combustion. The permitted uses are those indicated on the label and on each product sheet. Sensimilla does not in any way encourage uses other than those indicated or prohibited by law.
Do CBD oils and cosmetics have different regulations?
Yes. Oils, extracts, and cosmetic products are subject to the regulations specific to their category (e.g., cosmetic regulations for topical products). Each product specifies its intended use: it is important to adhere to the information provided on the label and not attribute undeclared purposes to the products.
Does CBD get you "high" or have psychoactive effects?
No. CBD is not a psychoactive substance and does not produce the "high" typical of THC. Sensimilla products maintain THC content within legal limits. This is general information and not medical advice.
Can I drive after using CBD products?
We advise maximum caution. Even with very small amounts of THC, roadside drug tests and laboratory tests can be extremely sensitive and detect traces of THC, with possible consequences during checks. Since individual responses and test sensitivity can vary, Sensimilla advises careful evaluation and not to drive if in doubt. The information provided here does not replace legal or medical advice.
Can a CBD product cause a positive drug test?
Drug tests typically look for traces of THC and its metabolites. Since hemp products may contain minimal amounts of THC within legal limits, it is not possible to completely rule out a positive result depending on the product, quantity, and test sensitivity. If you anticipate being tested (for example, at work or for medical reasons), consider this carefully and, if necessary, seek professional advice.
Is it legal to possess CBD products at home?
The possession of hemp products that comply with legal THC limits and permitted uses is generally allowed. We recommend keeping the receipt or proof of purchase and storing the products in their original packaging with the label intact.
